General Trading Conditions and Disclaimer
Millanoora®-Turkis-Jan OY (Ltd.)
§1. General Terms of application for the business relation between Millanoora®-Turkis-Jan Oy and the Buyer/Customer apply exclusively the below mentioned General Terms of Sale, valid at the time of order placement are considered. The Buyer/Customer agrees to these Terms expressly when placing the order. Turkis-Jan Oy (Ltd) does not recognize accept any deviating conditions of the Buyer/Customer, except Turkis-Jan Oy has accepted their validity expressly and in writing.
§2. You can order, in writing (a letter), with the purchase order form - please don’t forget your address and signature, by E-Mail or by telephone. For fur cap order it is essential that you send an extra e-mail to millanoora@millanoora.com with your measurements. The specified dimensions are the basis for the order execution.
By E-Mail you can send your order 24 hours daily on millanoora@millanoora.com.
§3. Conclusion and cancellation of the order. Turkis-Jan Oy (Ltd.) commits itself to accept orders of the Buyer/Customer on the conditions of the web page. The conditions are subject to writing, orthographic as well as calculation errors on the web page. In such cases Turkis-Jan Oy (Ltd.) is authorized to the withdrawal from the order.
The Buyer/Customer can withdraw from the order in writing, by E-Mail or by returning the merchandise (unused, originally packed and clean) within two weeks after delivery. Turkis-Jan Oy (Ltd.) points out that and eventual loss in value caused by the use can and will be deducted from the amount to be refunded.
Please indicate your account number and bank account for refund. Computed postage (EMS, USPS, UPS,..) and C.O.D. fees will not be refund. If the return is based on of material and/or processing errors (excluded of it are cattle skins marked as low-grade commodity are excluded.) Turkis-Jan Oy (Ltd.) refunds postage as well.
If suppliers of Turkis-Jan Oy (Ltd.) do not meet their contractual obligations, for whatever reasons, and do not supply Turkis-Jan Oy (Ltd.) with the ordered commodity, is Turkis-Jan Oy (Ltd.) likewise justified to the cancellation of the order (Turkis-Jan Oy - Customer). In such cases Turkis-Jan Oy (Ltd.) will inform you immediately about the fact, that the ordered commodity cannot be supplied. Possible pre-payment is refunded immediately.
§4. Supplies if not differently agreed upon, the supply usually takes place within two to four weeks from stock to the shipping-address, indicated by the Buyer/Customer. In case the delivery time is longer than normally, the Buyer/Customer is informed by Turkis-Jan Oy. Details over time/date for delivery are not binding, unless Turkis-Jan Oy has confirmed the date of delivery in writing. Turkis-Jan Oy reserves the right to refuse shipment of the merchandise on credit without further reason or change payment terms.
§5. Price adjustments and measuring (price reductions, changes in the discount tables, price increases) are valid with effect from date of the new price list, involving current orders as well. If prices have been modified, the Buyer/Customer is entitled to decide, whether the order will remain valid, this concerns, however, only large orders.
§6. Turkis-Jan Oy (Ltd.) is entitled to full payment of the current order by disturbances or interferences by higher force (e.g. strikes, walkouts, seizures and similar), if the order is executed up to 80 percent of it’s volume. Smaller achievements are to be paid without consideration for entire order price indicated in the valid price list.
§7. Cancellations or changes of an order must take place in writing within 14 days, beyond that cancellation or changes can not be accepted. Orders which have left the factory already, cancellation or changes are no longer possible, expenses including dispatch costs will be at the expense of the Buyer/Customer.
§8. If C.O.D. orders of the Buyer/Customer have not been called for and will be returned to Turkis-Jan Oy (Ltd.), Turkis-Jan Oy (Ltd.) is entitled to charge the buyer/customer for forwarding expenses by a percentage of 5 percent of the original order sum, at least, however, 35.00 EUR. In the case of delayed payment or deferral of payment please see clause §9.
§9. In the case of "Delay of payment or deferment of payment" the buyer/customer will be charged for interests (15%) as well as computed collection costs. Turkis-Jan Oy (Ltd.) can reset the distribution of a current order until full payment and require pre-payment for this order. If doubts considering the solvency of the client are well-grounded, Turkis-Jan Oy (Ltd.) is justified to modify the terms of delivery regarding terms of payment even for pending orders.
§10. Full conversion and right to return exist for all articles within 14 days. Forwarding expenses are at charge of the customer. Unstamped merchandise will not be redeemed by Turkis-Jan Oy (Ltd.). Special orders, purpose-made and tailor-made orders are excluded from conversion and right to return.
§11. Proprietary right: The goods remain property of the manufacturer until final payment, even if the Buyer/Customer conveys the commodity to a third party.
§12. Warranty and liability: If the purchased merchandise is non-marketable and Turkis-Jan Oy is responsible for the incorrectness, the customer is entitled to have it repaired or receive a new merchandise. This regulation does not involve special offers. If Turkis-Jan Oy is not capable of refuses to repair the defects in their sphere of responsibilities or send new merchandise as reasonable compensation or within a reasonable time on it’s efforts to repair the damage have failed or it was unable to supply new goods as a compensation the client is entitled to cancel the order or cut the price. If not agreed differently, requirements of the Buyer/Customer –on whatever juridical arguments they may be based –will not be accepted. Above all Turkis-Jan Oy (Ltd.) is not responsible for profit losses or other
damages to the property of the client/customer If Turkis-Jan Oy (Ltd.) is partially or completely excluded from the responsibility, this guiltlessness pertains also to employees and auxiliaries as well as representatives.
Above mentioned release from liability is not valid, if the damage is caused or through negligence.
If Turkis-Jan Oy (Ltd.) omits or hurts negligently a contract-substantial obligation, the obligation to indemnify for material damage is limited to the typically developed damage.
§13. Data security and privacy stands on first and highest place for Turkis-Jan Oy (Ltd.). Personal details which you enter in our web page, by letter, E-Mail or convey by telephone, are saved only for the use of Turkis-Jan Oy (Ltd.), and they serve exclusively the appointed purposes, i.e. for the completion of orders, supply of goods, completion of the payment and - so far agreed – for the execution of your further orders. This data will not be passed on for information purposes and/or advertising purposes for a third party or private businesses, unless you give your written agreement for this to Turkis-Jan Oy (Ltd.). The data is stored electronically. Personal data is basically coded. The data concerning telephone number and E-Mail address is necessary, to enable Turkis-Jan Oy to inform the customer quickly and easily regarding invoicing, modifications and/or delivery time. With the data input on the Turkis-Jan Oy (Ltd.) Internet site the IP number of your computer is also saved on the server.
The Buyer/Customer has been informed sufficiently about the kind, range, place and purpose of the data collection, processing and use of the personal data necessary for the execution of orders. The Buyer/Customer agrees expressly to this collection, processing and use of personal data.
§14. Customers E-Mail and password: You have the possibility to use our Internet side by using your E-Mail Adress with password. We kindly ask you to pay careful attention to the secrecy of the password to prevent an abuse. You are responsible for all procedures under your customer number. For organizational purposes to optimize offers via the Internet Turkis-Jan Oy can save details under your customer number. You have the right to contradict this at any time. On demand Turkis-Jan Oy gladly informs you, which details are saved under your name.
§15. Consent and right of revocation: If you agree on a certain use of your data on our Internet page, this will be on voluntary basis. You have the right to recall this consent at any time with effect for the future.
Turkis-Jan Oy (Ltd.) reserves itself the right to update data security references. In case of changes, which might count against the customer, Turkis-Jan Oy (Ltd.) will inform him/her on time.
§16. Applicable right and area of jurisdiction: It applies the commercial law of Finland. Area of jurisdiction Nilsiä and place of delivery is Fin-73620 Kortteinen.
§17. Salvatory clause:
Should any part of this agreement be invalid for any reason, it is to be replaced with a corresponding text, which is valid and equivalent to the intended meaning. The rest of the agreement shall remain unaffected and valid. Same applies to possible gaps of the present treaty.
Please consider, Turkis-Jan Oy (Ltd.) does not manufacture bulk commodities, each piece is hand-made and thus it is unique in its colour, material and processing. Therefore there might be some irregularities and deviations in the colour of the products.
